How long will your data be saved for?

What categories of data do we use and where do these derive from?

We process the data that is sent to us in relation to your application, in order to assess your suitability for the position (or possibly other vacant positions within our company) and to conduct the application process (e.g. first name, last name, name affixes, nationality, contact details such as private address, (mobile) phone number, e-mail address). This might also include special categories of personal data such as health-related data.

Your personal data is collected directly from you during the application process. We may also have obtained data from third parties (e.g. via job placement services).

Additionally, we process personal data that we have acquired reliably from publically accessible sources (e.g. business networks).

For what purposes and on what legal basis is your data processed?

We process your personal data while adhering to the provisions of the EU General Data Protection Regulation (GDPR), the German Federal Data Protection Act (BDSG), and all other key relevant legislation.

First and foremost, the processing of data serves to establish the possible grounds for an employment relationship. The predominant legal basis for this is Art. 6 (1) (b) of the GDPR in conjunction with Clause 26 (1) of the German Federal Data Protection Act (BDSG). In addition, your special consent pursuant to Art. 6 (1) (a) and Art. 7 of the GDPR shall be used as a data protection authorisation prescript.

If required, we also process your data in accordance with Article 6 (1) (f) of the GDPR, in order to preserve the legitimate interests of ourselves or of third parties (e.g. authorities). There shall be a legitimate interest in particular if any claims are asserted or defended.

Moreover, we are obliged pursuant to the European Anti-Terrorism Regulations 2580/2001 and 881/2002, to match your data against so-called “EU Terror Lists“ in order to ensure that no funds or other financial resources have been made available for terrorist purposes.

We also carry out data processing for statistical purposes.

If other categories of personal data pursuant to Article 9 (1) of the GDPR are processed, this shall serve within the scope of the application process to exercise rights or for the fulfilment of legal obligations relating to labour law, the right to social security and social protection (e.g. recording of severe disability in relation to additional leave and the assessment of disability contributions). This shall take place in accordance with Article 9 (2) (b) of the GDPR in conjunction with Clause 26 (3) of the German Federal Data Protection Act (BDSG). Additionally, the processing of health-related data may be required for the assessment of an individual’s capacity to work, pursuant to Art. 9 (2) (h) of the GDPR in conjunction with Clause 22 (1) (b) of the German Federal Data Protection Act (BDSG).

Who is given access to your data?

Your applicant data shall be viewed after receipt of your application by the HR department. Suitable applications will then be forwarded internally to the head of particular departments for the specific vacant position. The next steps in the application process will then be determined. Generally speaking, only those people within the company shall have access to your data who require this information for the orderly implementation of our application process.

In addition, we make use of various service providers. These include, in particular, software providers that may also receive access to your personal data in relation to the maintenance and administration of the systems. We have entered into a processing agreement with these providers, which ensure that date is processed in a reliable way.

In addition, we can share your personal data with other recipients within the company provided this is required for the fulfilment of contractual and legal obligations. This might be, e.g.:

How long will your data be saved for?

We will delete your personal data as soon as they are no longer required for the aforementioned purposes. In the case of a rejection, your personal data will be stored for the period in which claims for damages can potentially be made against us (a maximum of 6 months).

If you have consented to your personal data being saved once again we will transfer your data into our applicant pool. The data here will be deleted after a period of two years, provided no new communication has taken place with you in the meantime.

(i)      Auf unserer Seite nutzen wir auch zur einheitlichen Darstellung von Schriftarten sog. Webfonts, die uns von der Firma Monotype GmbH, Spichernstraße 2, 10777 Berlin im Rahmen eines Lizenzvertrags zur Nutzung überlassen werden. Rufen Sie eine Seite unserer Homepage auf, so lädt Ihr Browser die dafür benötigen Webfonts in Ihren Browser Cache, um dann Texte und Schriftarten korrekt anzeigen zu können. Hierfür muss der von Ihnen verwendete Browser mit den Servern von Monotype Kontakt aufnehmen. 

(ii)      Wir bezahlen für diesen Dienst an Monotype GmbH eine Vergütung, die sich an der Zahl erfolgten Seitenaufrufen orientiert, so dass Monotype die Seitenaufrufe zählt um die Angemessenheit der Vergütung zu kontrollieren. Hierfür verwendet Monotype ein Webfonts-Tracking-Script oder eine ähnliche Technologie – keine Cookies -. Dabei werden folgende Daten von einem externen Dienstleister der Muttergesellschaft Monotype Imaging Holdings Inc., 600 Unicorn Park Drive, Woburn, Massachusetts, 01801 USA (nachfolgend: Monotype Inc.) erhoben: 

  • die Identifikationsnummer des Webfont-Projekts (anonymisiert),
  • die URL der lizenzierten Website, die mit einer Kunden-ID verknüpft ist, damit Monotype uns und die von uns lizenzierten Webfonts identifizieren kann sowie
  •  die Referrer-URL.

Weiter wird Ihre IP-Adresse an den externen Dienstleister der Monotype Inc. übertragen, so dass er den Seitenaufruf zählt. Auf diese Weise wird Monotype darüber informiert, dass über Ihre IP-Adresse unsere Website aufgerufen wurde und dieser Umstand zur Bestimmung der von uns zu bezahlenden Lizenz genutzt.


(iii)     Ihre IP-Adresse wird nicht an Monotype Inc. oder Monotype GmbH weitergeleitet und auch nicht vom Dienstleister getrennt gespeichert oder verarbeitet. Vielmehr werden die erhobenen Daten zusammen mit der anonymisierten Identifikationsnummer des Webfonts-Projekts 30 Tage lang gespeichert. Nach dieser Auswertung und der Speicherung der Anzahl der Seitenaufrufe werden diese Protokolldateien gelöscht.

(iv)    Die Nutzung der Monotype Webfonts erfolgt auf der Basis unseres berechtigten Interesses im Sinne des Art. 6 Abs. 1 lit. f DSGVO an einer einheitlichen Darstellung unserer Inhalte auf unserer Webseite.

(v)     Monotype Inc. nimmt am EU-US Data Privacy Framework teil und ist in der Liste zertifizierter US-Unternehmen verzeichnet (https://www.dataprivacyframework.gov/list).
Zur grenzüberschreitenden Übermittlung von Personenbezogenen Daten nutzt Monotype Inc. zudem die EU Standardvertragsklauseln, um den in der Europäischen Union geltenden Datenschutzstandard einzuhalten. Welche Datenkategorien nutzen wir und woher stammen diese?

Für welche Zwecke und auf welcher Rechtsgrundlage werden Daten verarbeitet?


Wir verarbeiten Ihre personenbezogenen Daten unter Beachtung der Bestimmungen der EU-Datenschutz-Grundverordnung (DS-GVO), des Bundesdatenschutzgesetzes (BDSG) sowie aller weiteren maßgeblichen Gesetze.

In erster Linie dient die Datenverarbeitung der etwaigen Begründung des Beschäftigungsverhältnisses. Die vorrangige Rechtsgrundlage hierfür ist Art. 6 Abs. 1 b) DS-GVO i. V. m. § 26 Abs. 1 BDSG. Daneben Ihre gesonderten Einwilligungen gem. Art. 6 Abs. 1 a), 7 DS-GVO als datenschutzrechtliche Erlaubnisvorschrift herangezogen werden.

Soweit erforderlich verarbeiten wir Ihre Daten zudem auf Grundlage von Art. 6 Abs. 1 f) DS-GVO, um berechtigte Interessen von uns oder von Dritten (z. B. Behörden) zu wahren. Ein berechtigtes Interesse unsererseits besteht insbesondere in der Geltendmachung oder Abwehr von Ansprüchen.

Art. 9 Abs. 1 DS-GVO verarbeitet werden, dient dies im Rahmen des Bewerbungsprozesses der Ausübung von Rechten oder der Erfüllung von rechtlichen Pflichten aus dem Arbeitsrecht, dem Recht der sozialen Sicherheit und dem Sozialschutz (z. B. Zudem kann die Verarbeitung von Gesundheitsdaten für die Beurteilung Ihrer Arbeitsfähigkeit gem. Art. 9 Abs. 2 h) i. V. m. § 22 Abs. 1 b) BDSG erforderlich sein.

Daneben kann die Verarbeitung besonderer Kategorien personenbezogener Daten auf einer Einwilligung nach Art. 9 Abs. 2 a) DS-GVO i. V. m. § 26 Abs. 2 BDSG beruhen.

Sollten wir Ihre personenbezogenen Daten für einen oben nicht genannten Zweck verarbeiten wollen, werden wir Sie zuvor darüber informieren.


Wer bekommt Ihre Daten?


Ihre Bewerberdaten werden nach Eingang Ihrer Bewerbung von der Personalabteilung gesichtet. Geeignete Bewerbungen werden dann intern an die Abteilungsverantwortlichen für die jeweils offene Position weitergeleitet. Anschließend wird der weitere Ablauf abgestimmt. Im Unternehmen haben grundsätzlich nur die Personen Zugriff auf Ihre Daten, die dies für den ordnungsgemäßen Ablauf unseres Bewerbungsverfahrens benötigen.


Daneben bedienen wir uns unterschiedlicher Dienstleister. Hierzu zählen insbesondere Software-Anbieter, die im Zusammenhang mit der Wartung und Pflege der Systeme ggf. auch Kenntnis von Ihren personenbezogenen Daten erhalten. Wir haben mit diesem Anbieter einen Auftragsverarbeitungsvertrag abgeschlossen, der sicherstellt, dass die Datenverarbeitung in zulässiger Weise erfolgt.


Darüber hinaus können wir Ihre personenbezogenen Daten an weitere Empfänger außerhalb des Unternehmens übermitteln, soweit dies zur Erfüllung der vertraglichen und gesetzlichen Pflichten erforderlich ist. Dies können z. B. sein:


• Behörden (z. B. Rentenversicherungsträger, berufsständische Versorgungseinrichtungen, Sozialversicherungsträger, Finanzbehörden, Gerichte)


Welche Datenschutzrechte können Sie als Betroffener geltend machen?


Sie können unter der o.g. Adresse Auskunft über die zu Ihrer Person gespeicherten Daten verlangen. Darüber hinaus können Sie unter bestimmten Voraussetzungen die Berichtigung oder die Löschung Ihrer Daten verlangen. Ihnen kann weiterhin ein Recht auf Einschränkung der Verarbeitung Ihrer Daten sowie ein Recht auf Herausgabe der von Ihnen bereitgestellten Daten in einem strukturierten, gängigen und maschinenlesbaren Format zustehen.


Widerspruchsrecht

Sie haben das Recht, einer Verarbeitung Ihrer personenbezogenen Daten zu Zwecken der Direktwerbung ohne Angabe von Gründen zu widersprechen. Verarbeiten wir Ihre Daten zur Wahrung berechtigter Interessen, können Sie dieser Verarbeitung aus Gründen, die sich aus Ihrer besonderen Situation ergeben, widersprechen. Wir verarbeiten Ihre personenbezogenen Daten dann nicht mehr, es sei denn, wir können zwingende schutzwürdige Gründe für die Verarbeitung nachweisen, die Ihre Interessen, Rechte und Freiheiten überwiegen oder die Verarbeitung dient der Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen.



Wo können Sie sich beschweren?


Sie haben die Möglichkeit, sich mit einer Beschwerde an den oben genannten Datenschutz-beauftragten oder an eine Datenschutzaufsichtsbehörde zu wenden. Die für uns zuständige Datenschutzaufsichtsbehörde ist:

Wie lange werden Ihre Daten gespeichert?


Wir löschen Ihre personenbezogenen Daten, sobald sie für die oben genannten Zwecke nicht mehr erforderlich sind. Im Falle einer Absage, werden Ihre personenbezogenen Daten für die Zeit aufbewahrt, in der Ansprüche gegen uns geltend gemacht werden können (maximal 6 Monate).


Für den Fall, dass Sie einer weiteren Speicherung Ihrer personenbezogenen Daten zugestimmt haben, werden wir Ihre Daten in unseren Bewerber-Pool übernehmen. Dort werden die Daten nach Ablauf von zwei Jahren gelöscht, sofern keine erneute Kommunikation mit Ihnen stattgefunden hat.


Sollten Sie im Rahmen des Bewerbungsverfahrens den Zuschlag für eine Stelle erhalten haben, werden die Daten aus dem Bewerberdatensystem in unser Personalinformationssystem überführt.


Werden Ihre Daten in ein Drittland übermittelt?


Sollten wir personenbezogene Daten an Dienstleister außerhalb des Europäischen Wirtschaftsraums (EWR) übermitteln, erfolgt die Übermittlung nur, soweit dem Drittland durch die EU-Kommission ein angemessenes Datenschutzniveau bestätigt wurde oder andere angemessene Datenschutzgarantien (z. B. verbindliche unternehmensinterne Datenschutzvorschriften oder EU-Standardvertragsklauseln) vorhanden sind. Sind Sie verpflichtet, Ihre Daten bereitzustellen?


Im Rahmen Ihrer Bewerbung müssen Sie gegebenenfalls diejenigen personenbezogenen Daten bereitstellen, die für die etwaige Begründung des Beschäftigungsverhältnisses und der Erfüllung der damit verbundenen vertraglichen Pflichten erforderlich sind oder zu deren Erhebung wir gesetzlich verpflichtet sind. Ohne diese Daten werden wir nicht in der Lage sein, den Arbeitsvertrag mit Ihnen abzuschließen.
